Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between you and City Elite Group Inc., doing business as Festopia ("Festopia," "we," "us," or "our"). They govern your access to and use of festopia.com, the Festopia mobile experience, and every product or service we sell, including hotel packages, Event Passes, airport transfers, excursions, add-ons, and related travel and event services (collectively, the "Services").
By creating an account, making a booking, purchasing an Event Pass, enrolling in a payment plan, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
- You must be at least 18 years old to book travel, purchase an Event Pass, enroll in a payment plan, or attend a Festopia event.
- Certain destinations, venues, hotels, or activities may enforce a higher minimum age (commonly 21). It is your responsibility to confirm and comply with all age requirements.
- You represent that all information you provide is accurate, complete, and current, and that you have the legal capacity to enter into these Terms.
- Festopia may refuse service, cancel accounts, or void bookings that violate these Terms or applicable law.
2. Bookings & Payments
- All bookings are made through festopia.com and are subject to availability, verification, and acceptance by Festopia.
- Prices are quoted in U.S. Dollars unless otherwise stated and may change until checkout is completed.
- A booking is not confirmed until payment (or the initial installment) is successfully processed and Festopia issues a written confirmation.
- Festopia reserves the right to correct pricing errors, decline suspected fraudulent transactions, and cancel bookings that result from technical, typographical, or inventory errors.
- Payment is processed through Stripe and other payment providers described below. By submitting payment information, you authorize Festopia and its processors to charge the applicable amounts.
- Accepted payment methods include, without limitation: Stripe-processed credit and debit cards, Apple Pay, Google Pay, Link by Stripe, and Buy Now, Pay Later ("BNPL") providers made available through Stripe (including but not limited to Klarna, Affirm, and Afterpay), together with additional providers Festopia may add from time to time.
- Booking, service, and processing fees may apply and will be disclosed at checkout. These fees are non-refundable except where required by law.
3. Festopia Payment Plans & Installments
- Festopia offers optional payment plans that allow eligible customers to pay a deposit at checkout and the remaining balance in scheduled installments.
- The deposit, number of installments, installment amounts, billing dates, and final payment deadline are disclosed at checkout and form part of your booking.
- Once a booking is confirmed, the payment schedule is locked to your booking. Subsequent changes Festopia makes to default plan settings will not alter your existing schedule.
- Deposits and installment payments already made are non-refundable, except where required by law or expressly stated in a specific promotion.
- You are responsible for keeping a valid payment method on file until your balance is paid in full.
- Installment plans offered directly by Festopia are not credit products, are not loans, and do not accrue interest unless expressly stated. They are a scheduled payment arrangement tied to your booking.
4. Buy Now, Pay Later (Klarna, Affirm, Afterpay, and Future Providers)
Where available at checkout, you may finance an eligible purchase through a third-party Buy Now, Pay Later provider, including but not limited to Klarna, Affirm, Afterpay, and any additional financing providers that Stripe or Festopia makes available in the future.
- Financing approval, credit terms, repayment schedules, interest, fees, and late charges are determined solely by the financing provider.
- Festopia is not a lender, creditor, or financing partner and does not underwrite, approve, or service financing agreements.
- Any financing agreement is strictly between you and the financing provider and is governed by that provider's own terms, privacy policy, and disclosures.
- All refunds for Festopia products and services follow Festopia's refund policy set forth in these Terms, regardless of how you paid.
- Financing providers determine independently how a refund, cancellation, or partial refund affects your repayment schedule, outstanding balance, previously paid interest, or fees.
- You remain fully responsible for your financing agreement, including all scheduled payments, until the financing provider updates your account to reflect any refund or adjustment.
- Disputes about financing (approvals, denials, interest, fees, statements, or servicing) must be resolved directly with the financing provider.
5. Payment Authorization
- By providing a payment method, you authorize Festopia and its payment processors to charge that method for the initial payment, any scheduled installments, applicable taxes and fees, add-ons you approve, and any other amounts you agree to pay.
- You authorize Festopia to store your payment method (through Stripe or another PCI-compliant processor) and to attempt re-authorization or retry failed charges.
- You represent that you are the authorized user of the payment method and that sufficient funds or credit are available at the time of each charge.
- You may update your payment method at any time through your account. It is your responsibility to keep payment details accurate and current.
6. Failed Payments
- If a scheduled payment fails, Festopia may re-attempt the charge, notify you by email, SMS, or in-app message, and place your booking in a past-due status.
- You are responsible for resolving failed payments promptly by updating your payment method or completing payment manually.
- Persistent non-payment may result in suspension of your booking, cancellation without refund of amounts previously paid, forfeiture of your deposit and installments, release of held inventory, and cancellation of any associated Event Passes, hotel rooms, transfers, or add-ons.
- Festopia may charge reasonable administrative fees, retry fees, or reinstatement fees where permitted by law and disclosed at the time.
7. Chargebacks & Payment Disputes
- If you believe a charge is incorrect, contact Festopia support first at support@festopia.com so we can investigate and resolve the issue.
- Initiating a chargeback for a legitimate, authorized purchase (including non-refundable deposits, installments, and Event Passes) may be considered a breach of these Terms.
- Festopia reserves the right to contest chargebacks with full transaction records, communications, and evidence of services rendered or reserved.
- Bookings, Event Passes, and accounts associated with fraudulent or bad-faith chargebacks may be cancelled without refund, and Festopia may recover collection costs, administrative fees, and legal fees to the extent permitted by law.
8. Event Passes
- Event Passes are sold in limited quantities and in tiered pricing structures (for example, Early Bird, General Admission, VIP). Pricing tiers may increase at any time without notice.
- Inventory is limited and Event Passes may sell out. Availability at any given price is not guaranteed until checkout is completed.
- Each Event Pass includes a unique QR code or credential. QR codes may not be duplicated, screenshotted for resale, altered, tampered with, or transferred. Only the first scan of a valid QR code will be admitted.
- Passes are non-transferable except where expressly permitted by Festopia in writing. Unauthorized transfers may result in cancellation without refund.
- Resale of Event Passes above face value, on unauthorized secondary marketplaces, or in violation of local law is prohibited and may result in cancellation of the pass.
- Event Passes purchased through fraudulent means, stolen payment methods, unauthorized bots, or in violation of these Terms may be cancelled at any time without refund.
- Event Passes are non-refundable except where required by law or expressly offered by Festopia.
9. Hotel Packages
- Hotel packages are sold based on room type, occupancy, and stay dates disclosed at checkout. You must comply with the maximum occupancy for your room; hotels may deny access to additional guests.
- Room assignments are subject to hotel availability. Special requests (bedding configuration, view, floor, connecting rooms) are requests only and are not guaranteed.
- Hotels reserve the right to substitute comparable accommodations of equal or greater standard in the event of overbooking, maintenance, or operational needs.
- Incidental charges — including but not limited to minibar, room service, spa services, laundry, telephone, damages, and lost keys — are the sole responsibility of the guest and must be settled directly with the hotel.
- Check-in typically requires a valid government-issued photo ID and a credit or debit card for incidentals. Age requirements at check-in may exceed 18.
- You are responsible for damage to hotel property caused by you or members of your booking and authorize the hotel to charge the responsible guest directly.
- Resort fees, tourism taxes, environmental fees, or other mandatory charges may be imposed by the hotel or destination and, unless expressly included in your package, are payable directly to the hotel.
10. Airport Transfers
- Airport transfers, where offered, are group transportation services operating on limited dates and times aligned with the event weekend.
- You must submit accurate flight information (carrier, flight number, arrival and departure times) by the deadline communicated by Festopia. Late or incorrect flight information may result in loss of the transfer with no refund.
- Missed transfers due to delayed flights, missed connections, incorrect flight details, immigration/customs delays, or failure to arrive at the pickup point on time are not the responsibility of Festopia.
- Transportation schedules, pickup points, and vehicles may change based on operational needs and the number of confirmed passengers.
- Transfers are operated by independent third-party ground transportation providers whose terms and safety policies apply in addition to these Terms.
11. Excursions & Third-Party Activities
- Excursions, tours, water activities, and similar experiences offered on festopia.com may be operated by independent third-party operators.
- Festopia acts solely as a facilitator or reseller and is not responsible for the operation, safety, staffing, equipment, weather delays, cancellations, injuries, accidents, illness, or property loss associated with third-party operators.
- You participate in excursions and third-party activities at your own risk and agree to comply with the operator's terms, safety instructions, waivers, and eligibility requirements.
- Cancellations or changes to excursions initiated by the operator (including weather-based cancellations) will be handled according to the operator's policies. Where feasible, Festopia will assist in requesting a refund or rescheduling but does not guarantee any specific outcome.
12. Group Bookings
- Group leaders are responsible for inviting roommates and travelers, managing invitations, and ensuring each member completes their booking on time.
- Festopia is not responsible for disputes among group members regarding payments, roommate arrangements, cancellations, or splitting costs.
- If a group member fails to pay or cancels, the remaining group members may be responsible for the unfilled share or accept a different room assignment; refunds are not automatic.
13. Room Occupancy
- Each hotel room has a maximum occupancy set by the hotel. Additional guests beyond that limit are not permitted and may be denied entry by the hotel.
- Pricing is based on the number of travelers disclosed at booking. Adding travelers after booking may require re-pricing and additional fees, subject to availability.
- Children, infants, and additional guests must be disclosed at checkout; hotels may charge extra fees or require additional documentation.
14. Customer Cancellations
- Because Festopia pre-purchases hotel inventory, talent, venues, transportation, and excursions well in advance, customer-initiated cancellations forfeit all deposits and previously paid installments.
- Name changes, roommate changes, room type changes, or transfers of a booking to another person are handled case-by-case, subject to hotel and supplier approval, and may incur administrative fees.
- No-shows, early departures, and unused portions of a package are non-refundable.
- We strongly recommend purchasing travel insurance to protect against cancellations for medical, personal, or other reasons.
15. Changes Made by Festopia
Festopia reserves the right, at its sole discretion, to:
- Substitute hotels, room categories, venues, artists, DJs, performers, transportation providers, excursions, schedules, or activities with reasonably comparable alternatives.
- Adjust programming, timing, or lineup due to weather, safety, travel restrictions, supplier issues, or circumstances beyond our reasonable control.
- Modify itineraries, event locations, or operating hours to protect the safety and enjoyment of attendees.
Such changes do not automatically create refund eligibility. Festopia will use commercially reasonable efforts to provide comparable alternatives.
16. Artist, DJ & Event Lineup Changes
- Artist, DJ, host, and performer lineups are subject to change without notice.
- The addition, removal, substitution, or reordering of performers does not entitle you to a refund, credit, or exchange.
- Set times, stages, and programming may be modified for operational, safety, or artist-availability reasons.
17. Weather Policy
- Events, activities, and transportation may proceed as scheduled during rain and typical weather conditions common to the destination.
- Programming may be delayed, shortened, relocated, or cancelled due to hurricanes, tropical storms, lightning, extreme heat, high winds, or other severe weather.
- Weather-related changes do not automatically create refund eligibility. Where possible, Festopia will offer reasonable substitutions or rescheduling.
18. Force Majeure
Festopia shall not be liable for any delay, cancellation, modification, or failure to perform caused by events beyond its reasonable control, including but not limited to:
- Hurricanes, tropical storms, floods, earthquakes, and other natural disasters
- Pandemics, epidemics, and public health emergencies
- Government restrictions, travel advisories, border closures, and visa denials
- Airline disruptions, air traffic control issues, and airport closures
- Civil unrest, riots, strikes, labor disputes, acts of terrorism, and war
- Supplier failures, hotel closures, and venue unavailability
- Utility outages, internet or telecommunications failures, and cybersecurity incidents
- Any other event beyond Festopia's reasonable control
In a force majeure event, Festopia may cancel, reschedule, or substitute Services and is not required to provide refunds beyond what is required by law.
19. Travel Requirements
You are solely responsible for meeting all destination entry requirements. Requirements change frequently and vary by nationality, residency, and itinerary.
20. Flights & Transportation
- Unless expressly included in your package, flights and other transportation to and from the destination are your responsibility.
- Festopia is not responsible for missed flights, cancellations, delays, rebooking fees, baggage fees, lost luggage, or schedule changes made by airlines or transportation providers.
- You should book flights only after your Festopia booking is confirmed and reconfirm all times prior to travel.
21. Passports & Entry Requirements
- You are responsible for holding a valid passport, visa, vaccination records, and any other documents required for entry and exit.
- Many destinations require a passport valid for at least six months beyond the date of travel and one or more blank pages.
- Festopia is not responsible for denied boarding, denied entry, or deportation resulting from insufficient or incorrect documentation.
22. Travel Insurance Recommendation
Festopia strongly recommends purchasing comprehensive travel insurance covering trip cancellation, trip interruption, medical care, medical evacuation, baggage loss, and travel delays. Festopia does not sell travel insurance and does not guarantee that any particular loss will be reimbursable.
23. Hotel Policies
- You agree to comply with the policies of the hotel where you stay, including check-in and check-out times, quiet hours, pool and beach rules, dress codes, and wristband policies.
- Hotels may require a credit card authorization at check-in for incidentals and damages.
- Failure to comply with hotel policies may result in additional charges, room reassignment, or removal from the property without refund.
24. Customer Conduct
Festopia may remove you from an event, venue, hotel, transfer, or excursion without refund for:
- Illegal activity of any kind
- Violence, threats, harassment, or discrimination
- Property damage or theft
- Dangerous, reckless, or disruptive behavior
- Violating venue, hotel, or transportation provider rules
- Refusing lawful instructions from Festopia staff, security, or local authorities
25. Health & Safety
- You represent that you are physically and mentally fit to participate in the Services you purchase, including any excursions or activities.
- You are responsible for disclosing to third-party operators any medical conditions, allergies, dietary needs, mobility restrictions, or accommodations you require.
- Festopia is not a medical provider and does not provide medical advice; consult your physician regarding travel, vaccinations, and activity readiness.
26. Alcohol Responsibility
- Where alcohol is available (including all-inclusive resort packages and events), consumption is entirely at your own risk and subject to local law.
- Festopia, its suppliers, and its venues reserve the right to refuse service to any guest who appears intoxicated or is behaving unsafely.
- You are responsible for consuming alcohol responsibly and for any consequences of your consumption, including injury, property damage, and legal liability.
27. Photo & Video Release
By attending a Festopia event or participating in a Festopia experience, you grant Festopia and its affiliates, licensees, and partners a perpetual, worldwide, royalty-free, irrevocable right to photograph, film, record, and use your name, likeness, voice, and image in any media for advertising, marketing, editorial, and promotional purposes, without further notice, approval, or compensation.
28. Intellectual Property
- All content on festopia.com — including logos, trademarks, text, graphics, photography, video, audio, code, and design — is owned by or licensed to Festopia and is protected by intellectual property laws.
- You may not copy, reproduce, distribute, modify, publicly display, publicly perform, or create derivative works from any Festopia content without prior written permission.
- "Festopia" and related brands, logos, and taglines are trademarks of City Elite Group Inc.
29. Website Use
You agree not to:
- Scrape, harvest, or index festopia.com by any automated means
- Use bots, crawlers, or other automated tools to interact with the Services
- Copy, mirror, or republish festopia.com content without authorization
- Reverse engineer, decompile, or attempt to derive source code from the Services
- Use the Services for unauthorized commercial purposes, including reselling inventory or reselling Event Passes
- Share account credentials or allow unauthorized access to your account
- Submit fraudulent bookings, use stolen payment methods, or use synthetic identities
- Interfere with, disrupt, or overload festopia.com or any related infrastructure
Violations may result in suspension or termination of your account and cancellation of associated bookings without refund.
30. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must notify Festopia immediately of any unauthorized access or suspected security breach.
- Festopia may suspend or terminate accounts that violate these Terms, contain false information, or are associated with fraudulent activity.
31. SMS & Email Communications
By creating an account or making a booking, you agree to receive transactional communications from Festopia, including:
- Booking confirmations and receipts
- Payment reminders and installment notices
- Trip updates and pre-travel information
- Event notifications, schedule changes, and safety alerts
- Customer support communications
These communications are necessary to service your booking and cannot be opted out of while an active booking exists. Marketing communications are optional and subject to your preferences; you may unsubscribe from marketing at any time by using the unsubscribe link in an email or by replying STOP to a marketing SMS. Message and data rates may apply.
32. Third-Party Services
The Services rely on and integrate with third-party providers, including but not limited to: Stripe (payment processing), Klarna, Affirm, Afterpax and other financing providers, hotels, airlines, ground transportation providers, excursion companies, venues, and ticketing services.
- Each third party operates under its own terms of service, privacy policy, and applicable law.
- Festopia is not responsible for the acts, omissions, errors, or failures of third-party providers, except as expressly required by law.
- Your use of a third-party service through Festopia constitutes acceptance of that provider's terms.
33. Limitation of Liability
To the maximum extent permitted by law, Festopia, City Elite Group Inc., and their respective officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, loss of data, loss of goodwill, or business interruption, arising out of or related to the Services, even if advised of the possibility of such damages.
Without limiting the foregoing, Festopia is not liable for losses caused by:
- Hotels, resorts, and lodging providers
- Airlines and air travel disruptions
- Ground transportation and transfer providers
- Excursion operators and third-party activity providers
- Payment processors, card networks, and banks
- Financing providers, including BNPL providers
- Weather and acts of nature
- Lost, delayed, or damaged baggage or personal property
- Missed flights, missed connections, and immigration/customs delays
- Delays of any kind
- Injury, illness, or death occurring through or during services provided by independent third parties
To the maximum extent permitted by law, Festopia's total aggregate liability arising out of or related to your booking or use of the Services shall not exceed the amount you actually paid to Festopia for the specific booking or Event Pass giving rise to the claim.
34. Indemnification
You agree to defend, indemnify, and hold harmless Festopia, City Elite Group Inc., and their respective officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Services; (ii) your violation of these Terms; (iii) your violation of any third-party right, including intellectual property, privacy, or contractual rights; or (iv) your conduct at any Festopia event, hotel, transfer, or excursion.
35. Governing Law
These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by applicable U.S. federal law.
36. Arbitration & Dispute Resolution
- The parties agree to attempt in good faith to resolve any dispute through informal negotiation and, if unsuccessful, non-binding mediation before initiating formal proceedings.
- If mediation fails, any dispute, claim, or controversy arising out of or related to these Terms or the Services shall be resolved through final and binding arbitration administered in New York, New York, in accordance with the rules of a nationally recognized arbitration provider selected by Festopia.
- Arbitration shall be conducted on an individual basis. You waive any right to participate in a class action, class arbitration, or representative action, to the maximum extent permitted by law.
- Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for intellectual property or confidentiality matters, or from bringing claims in small-claims court where jurisdiction permits.
- Nothing in this section waives any right that cannot be waived under applicable law.
37. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
38. No Waiver
Festopia's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Festopia.
39. Changes to Terms
Festopia may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be communicated by reasonable means, which may include email, in-app notice, or a notice on festopia.com. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
